The Food and Drug Administration said Wednesday that it had ordered a request for an investigation into whether a company marketed prescription drug Nexium and a generic form of AstraZeneca's drug Prilosec in Turkey, a move that would be illegal and possibly set off a legal challenge to the company.
The move by the FDA comes after several studies that showed AstraZeneca's product, which treats heartburn, caused heartburn in patients.
The drug was approved by the Food and Drug Administration on Nov. 26, 2005. AstraZeneca had a price of $1.85 billion for Nexium from 2007 to 2008.
The drug's maker, Abbott Laboratories, is in legal trouble, with the government claiming it is paying for Nexium.
But the FDA said there was a legal problem and the company had filed a lawsuit to challenge the drug's marketing.
"The FDA has requested that any manufacturer, wholesaler, or third party pay for or defend any conduct in this litigation that is likely to be an abuse of the patent," FDA spokeswoman Laura Berger said in a statement.
The company said it would "review all of the information that we have on this product and will not approve any of the allegations" unless the FDA deems it to be necessary.
In a statement, Abbott said it had not determined whether the marketing would harm the company.
"This is a company that has been making millions of dollars on a product that has not been approved for use," Abbott said in a statement.
Abbott said the drug maker has "exact compliance with the applicable regulatory standards" and had not made any decisions on the issue.
The statement continued, "We are unable to be reached for comment. All statements and projections are our own."
Abbott has not commented on the case.
GlaxoSmithKline Plc said Wednesday that it has agreed to settle all legal disputes about the drug over the past five years."We will not hesitate to bring a lawsuit against the makers of the drugs for their illegal marketing conduct," GSK Plc said in a statement.
AstraZeneca, the maker of Prilosec, and AstraZeneca GSK, the largest manufacturer of Nexium, had been trying to launch two generic drugs for heartburn. In 2006, Prilosec caused heartburn in patients who took the drug, but GSK said the drug had no effect on the symptoms of the disease.
In 2008, a study showed that Prilosec doubled the risk of heart attack in patients who took the drug and in 2008, GSK agreed to market a generic version of Prilosec.
In 2008, AstraZeneca agreed to pay $50 million to settle a class-action lawsuit alleging the company engaged in conduct in bad faith.
Mylan said Wednesday that AstraZeneca and GSK were in legal trouble in Canada and could not comment. The Canadian Food and Drug Association said Wednesday it was considering a lawsuit filed by a class action lawsuit against a company, alleging that GlaxoSmithKline failed to adequately warn consumers of the risk of heartburn.AstraZeneca said the company's legal argument is "without merit." The company also said that the FDA's investigation is "not likely to impact GlaxoSmithKline."The Canadian government said it would respond to a request by Abbott Laboratories for a letter of opposition to the lawsuit, and AstraZeneca would have to pay a $10 million settlement in the amount of $5.7 billion.
Abbott said that it was "determined by this litigation that this case is appropriate, and the company has the right to continue to make these allegations."The Canadian government said Thursday that the company had requested a "proceeding" from the FDA to determine whether it could violate the federal Food, Drug and Cosmetic Act.
